Welcome to The Job Log. Please read these Terms of Service (hereinafter referred to as the “Terms” or the “Agreement”) with meticulous care. By registering an account, purchasing premium access, or interacting with the ATS-first resume builder, job tracker, and digital tools located at thejoblog.com (collectively, the “Service” or the “Platform”), you signify your explicit, unreserved, and legally binding agreement to comply with and be bound by the clauses set forth herein. If you do not agree to these Terms in their entirety, you are strictly prohibited from accessing or utilizing this Service.
1. Acceptance of Agreement & Age/Legal Capacity
This Agreement is a legally binding contract between you and The Job Log.
Age Limitations & Representations: By registering an account or interacting with the Platform, you warrant and represent that you are at least thirteen (13) years of age (or sixteen (16) within specific EEA jurisdictions) and possess the full legal capacity to enter into a binding contractual arrangement under your governing jurisdiction.
If you are between the ages of thirteen (13) and eighteen (18), you represent that your legal guardian has reviewed and consented to this Agreement on your behalf. If you are accessing or using the Service on behalf of a company, corporate enterprise, or organization, you represent and warrant that you hold the necessary legal authority to bind such entity to these Terms.
2. License Grant, Scope of Use & Prohibited Commercial Agency
Subject to your strict compliance with this Agreement and receipt of payment (where applicable), the Platform grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and utilize the Service to create, format, tailor, and track resume documents for your own individual, personal job search and professional career progression.
Business & Commercial Use Resolution: For the avoidance of doubt, you are fully authorized to use resumes and job portfolios created on the Platform to pursue professional employment, consulting roles, or contracting careers. However, third-party commercial service agency use is strictly prohibited:
- Agency & Recruiter Restriction: You may not utilize this Service, its templates, or its rendering engine as a professional resume writing agency, staffing firm, recruitment consultancy, or career coaching agency to compile, rewrite, or structure resumes for third-party clients for fees or commercial compensation, unless you have entered into a separate, written enterprise license agreement with The Job Log.
Technical Restrictive Covenants: You agree and covenant that you will not:
- Incorporate, inject, or execute scripts, automated bots, scrapers, indexers, or other automated data extraction methodologies to harvest templates, designs, system code, or user metadata from the Platform.
- Decompile, reverse-engineer, disassemble, decode, or attempt to isolate the underlying source code, CSS system structure, UI components, or Supabase database schemas of the Service.
- Utilize the Service's structural databases, layout rendering engines, or structured resume schemas to construct, train, or optimize competing digital builders, AI-driven SaaS utilities, or job tracking platforms.
- Attempt to bypass, manipulate, or breach any security gates, including Supabase Row-Level Security (RLS) configurations, to read or modify data records not belonging to your authenticated account ID.
3. Bring Your Own Key (BYOK) Compliance & Generative AI Responsibility
A major operational feature of the Platform is its integrated generative AI resume tailoring workflow powered by the Google Gemini API.
User API Key Compliance & Responsibility:
- To access generative AI services, you are required to procure and configure your own valid Google Gemini API key via your personal Google AI Studio account.
- You understand, acknowledge, and agree that you retain sole financial and legal liability for all costs, charges, or invoicing accrued under your connected API key. Google will invoice you directly for your API token consumption. The Platform is not responsible for any billing disputes arising between you and Google.
- You covenant that you will not submit hijacked, fraudulent, invalid, or unauthorized API keys to the Service. The Platform reserves the right to suspend or terminate accounts engaging in systematic API key abuses.
- You represent and warrant that all content, job descriptions, and professional histories submitted to the generative AI pipeline do not infringe upon any third-party intellectual property or violate statutory regulations.
4. Intellectual Property & Document Ownership
You retain 100% intellectual property ownership of all raw data, resumes, summaries, certificates, bullet points, cover letters, and shared portfolio files generated on the Platform. We assert no ownership, copyright, or royalty claims over the resumes you build.
The Service, including the structured user-interfaces, PDF rendering scripts, DOCX styling engines, Kanban application designs, logos (including static and animated assets), system source code, proprietary templates, and CSS styling systems, remains the exclusive property of The Job Log. All rights not explicitly granted are strictly reserved.
5. Stripe Billing, Lifetime Access & Refund Covenants
The Service provides a one-time payment option to upgrade your account to Lifetime Access. Payments are executed and audited via our secure third-party merchant provider, Stripe, Inc.
Digital Delivery & Final Sale Disclaimer: Upon payment confirmation via Stripe's webhooks, premium features (including templates, sharing tools, DOCX exports, and trackers) are instantly and permanently provisioned to your account database. Due to the immediate digital delivery and consumption nature of these SaaS digital assets, all purchases are final, absolute, and strictly non-refundable once premium access is granted. By purchasing the upgrade, you explicitly waive your right to a cooling-off period, except where strictly mandated under local consumer protection statutes.
6. User Indemnification Covenants
You agree to defend, indemnify, and hold harmless The Job Log, its affiliates, contractors, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, obligations, costs, debt, and expenses (including but not limited to reasonable legal and attorneys' fees) arising out of or resulting from: (i) your access to, use of, or inability to use the Service; (ii) your breach or violation of any provision of this Agreement; (iii) your infringement or misappropriation of any third-party rights, including without limitation any intellectual property rights, moral rights, data privacy rights, or publicity rights; (iv) your violation of any statutory regulations, ordinances, or global guidelines; or (v) any payloads, prompts, credentials (including Google Gemini API keys), or resume texts uploaded, committed, or transmitted by you or via your account.
7. Absolute Disclaimer of Warranties & Employment Outcomes
Crucial Covenant Regarding Employment Success
THE SERVICE IS OPERATED PURELY AS A COLLABORATIVE TEXT WRITING AND STRUCTURAL FORMATTING COMPANION. WE MAKE NO WARRANTIES, REPRESENTATIONS, OR ASSURANCES THAT UTILIZING THE ATS RESUME TEMPLATES, THE KANBAN TRACKER, OR THE AI GENERATIVE TAILORING SYSTEM WILL SECURE AN INTERVIEW, LAND A JOB OFFER, GAIN EMPLOYMENT, OR SATISFY A HIRING COMMITTEE. EMPLOYMENT DECISIONS ARE COMPLETELY SUBJECTIVE AND BEYOND OUR CONTROL.
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE JOB LOG, ITS CONTRACTORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES—INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF CONTRACTS, DAMAGE TO CORPORATE REPUTATION, LOSS OF DATA, OR API KEY OVERUSE CHARGES—ARISING OUT OF OR RELATING TO YOUR ACCESS TO, INABILITY TO ACCESS, OR USE OF THE SERVICE, EVEN IF FOREWARNED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Governing Law, Venue & Binding SIAC Arbitration
This Agreement and any dispute, controversy, or claim arising out of or in connection with it (including its formation, interpretation, performance, breach, or validity) shall be governed by, and construed in accordance with, the laws of Singapore, without regard to conflict of laws principles.
Singapore International Arbitration Centre (SIAC): Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by binding arbitration administered by the Singapore International Arbitration Centre (SIAC)in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) in force at the time of commencement of the arbitration, which rules are deemed to be incorporated by reference in this clause.
- The seat of the arbitration shall be Singapore.
- The Tribunal shall consist of one (1) arbitrator.
- The language of the arbitration shall be English.
Subject to the SIAC arbitration covenant, any legal suit, action, or judicial proceeding arising out of or related to this Agreement that is not legally referable to arbitration shall be instituted exclusively in the competent courts of Singapore, and both parties explicitly submit to the personal and exclusive jurisdiction of such courts.
10. Severability & Entire Agreement
These Terms, in conjunction with our Privacy Policy, constitute the entire, legally integrated Agreement between you and The Job Log regarding the Service. If any provision of this Agreement is held by an arbitrator or a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining covenants shall remain in full force and effect.
